Privacy Policy

What personal data we process, why, who we share it with, and your rights.

1. Who we are

Farm Fayre EMC Limited is the data controller for personal data processed on the Farm Fayre platform. Contact us through the Support page or at the address on our Contact page. This policy explains what we collect, why, who we share it with, how long we keep it, and your rights.

2. What we collect

Account and identity: name, business name, phone (verified), email, addresses, herd numbers, and, for sellers, the payout and identity information collected by the payment institution. Trading data: listings, media, offers, sales, settlements and Settlement Figures, reviews, issues raised and their outcomes, and haulage records including weigh records and docket images. Herd and animal data: where you connect your herd data, the data described in clause 5. Communications: messages we send and receive with you, and Q&A posts. Technical data: device, log and usage information needed to run and secure the Platform. Calls and meetings may be recorded for accurate business records on the basis of legitimate interest; you can ask us not to record you, or to access or delete a recording, at any time.

3. Why we process it, and the legal bases

To provide the Platform and complete trades (contract). To verify identity, prevent fraud and keep the marketplace honest, including automated checks that flag unusual activity, contact details in listings or Q&A, and off-platform steering for human review (legitimate interest; no decision with legal or similarly significant effect is taken about you by automated means alone). To send service and transactional messages (contract). To send marketing you have opted into, which you can stop at any time (consent). To display herd and animal data you have connected (consent). To meet legal obligations, including tax and accounting law (legal obligation). To support the payment institution’s anti-money-laundering and customer due-diligence obligations (legitimate interest). To establish or defend legal claims (legitimate interest).

4. Who we share it with

Your counterparty on a trade, at the completion stages described in the User Agreement, for that trade only. The payment institution, which handles payment data to provide its services and acts as an independent controller for its own legal obligations, including customer due diligence; its own privacy statement applies to that. Independent hauliers, who receive the collection and delivery details needed for the job and are bound to confidentiality and data protection obligations. Herd data providers, when you connect your account, as described in clause 5. Our service providers for hosting and messaging, and professional advisers. A buyer of our business, on terms no less protective, with notice to you.

Some of our service providers process data outside the European Economic Area. Where that happens, the transfer is protected by European Commission adequacy decisions or approved safeguards such as standard contractual clauses.

5. Herd data

If you choose to connect your herd account, you give one consent that does two things, both stated plainly at the point of consent: it lets us complete your listings from your herd data, and it lets us tell you when a buyer is looking for what you have. You can disconnect herd data at any time in your profile; disconnection stops future pulls and does not affect completed listings or trades.

6. Retention

Account data is kept while your account is open and, after closure, for as long as needed to meet legal obligations and resolve disputes. Trading, settlement, fee invoice and tax records are kept for the periods Irish tax and company law require, typically six years after the year they relate to. Recordings, logs and technical data are kept only as long as their purpose requires. When nothing requires it any longer, data is deleted or anonymised.

7. Your rights

You have the rights of access, rectification, erasure, restriction, portability and objection, and the right to withdraw any consent at any time without affecting past processing. Contact us through Support to exercise them; we answer within a month. You can complain to the Data Protection Commission (dataprotection.ie) at any time, though we would ask you to talk to us first.

8. Security and changes

Data is held on secure servers in EU data centres, with nightly EU-resident backups, encryption in transit, and access controls. No internet transmission is completely secure, and we take all reasonable technical and organisational measures to protect your data. Changes to this policy are posted here, and significant changes are notified to you by email before they take effect.
